Daily Brat General Terms & Conditions

Article 1.          Definitions and Relevance

These are the terms and conditions of Daily Brat. These Conditions apply to all orders placed by you (customer/client) with Daily Brat via the webstore (www.dailybrat.com) and via the wholesale platforms used by Daily Brat. By placing an order, you (the customer/client) agree to the applicability of these Conditions on the agreement between you and Daily Brat. Any deviation to the Terms and Condition must be made in writing, in which case the remaining conditions are unabbreviated valid.

Daily Brat will use the details provided by you (customer/client) only in the manner indicated in the privacy statement, which is available on its website. It is important that you (customer/client) correctly and entirely provide including but not limited to your name, your e-mail address and the delivery address as per the instructions on the webstore. You are responsible for the accuracy of the details.


Article 2.          Offer and Agreement

You (customer/client) enter into an agreement with Daily Brat when you buy an article via the webstore or wholesale platform of Daily Brat. The agreement starts when Daily Brat has sent an order confirmation to the e-mail address specified by you, however Daily Brat has the rights to decline orders or attach certain conditions to the distribution. In the event Daily Brat declines an order, Daily brat will communicate this. In case Daily Brat decline Daily Brat will refund, in case the payment is complete and received by Daily Brat, the declined part of the order.

An agreement arising from an offer which contains an obvious mistake and/or error, such as an unusually low price, is not binding upon Daily Brat. Please contact Daily Brat when you doubt the validity of an offer.


Article 3.          Price and Payment

The price quoted in the webstore for offered products and services are in Euro’s including VAT. Custom clearance and or import/export duties are not included in the price and are the responsibility and on account of the customer/client.

Delivery cost can be found on the webstore of Daily Brat and may be different per country. During the checkout procedure the customer/client see the total amount including shipping cost. After making an order, the customer/client receives automatically an e-mail confirmation to the e-mail address specified by customer/client containing the total costs, including shipping costs. You can pay for your order in the ways indicated in the webstore of Daily Brat.


Article 4.          Order Processing and Delivery

Daily Brat aims to process and deliver your order as quickly as possible. In the not likely event that the relevant order is no longer available or undeliverable, Daily Brat will inform the customer/client and refund the paid amount for the relevant product.

Daily Brat deliver your order based on the information, delivery address, you provide. Daily Brat is not responsible for lost or added cost when you made a mistake in providing your contact / shipping / delivery details.

The customer/client must check if the ordered articles can be exported and imported to the country in question and what the costs are, before placing such an order. The related cost for including but not limited to export and import are for account of the customer/client. Ownership of the ordered products passes to you as soon as Daily Brat has received full payment.

Daily Brat and it subcontractors takes care to ensure that products are shipped correctly. Should you surprisingly receive incomplete or damaged products, please contact Daily Brat.


Article 5.          Liability and Quality

Every liability to Daily Brat ,its personnel and its products for including but not limited to all damage, of any nature, direct or indirect, including business damage(loss), consequential loss, damage to real property or persons, is explicitly excluded.

The products in the Daily Brat collection are produced to meet your expected quality standards. However, all the products are designed from an aesthetic point of view, and not with a view of optimum lifespan, practical usefulness or ease of use. Daily Brat assumes no liability for damage resulting from the use of Daily Brat products.

Every liability of Daily Brat towards the buyer is in every case limited to not more than the invoiced amount the customer/client owes Daily Brat in respect to the concerning agreement.


Article 6.          Right of Withdrawal (not applicable for orders placed via the wholesale platforms)

After purchasing products you (customer/client) has the right to withdraw the products within 14 days. Detailed information about the procedure and withdrawal terms can be found in the shipping and return instruction on www.dailybrat.com.


During this period the customer/client shall handle the products and the package carefully. You will unpack or use the products only to judge if you wishes to keep the product. If you want to execute the right of withdrawal, you shall return the product with all accessories and (if reasonably possible) in the original conditioning and packaging to Daily Brat, in accordance with the provided reasonable and clear instructions of Daily Brat. If the customer/client executes the right of withdrawal, you have to pay the costs of returning the product.


Article 7.          Privacy

The privacy policy can be found on the webstore www.dailybrat.com. All personal information will never be shared with or available to third parties (legal duties excluded). Dutch law applies to this privacy declaration.


Article 8.          Disputes and Applicable Law

Dutch law exclusively applies to all agreements between Daily Brat and customer/client, as well as to issues relating to subject-matter and territorial jurisdiction, even if submitted to a court abroad. In case of dispute, the Dutch law applies. All disputes between parties will exclusively be presented to the competent court in Amsterdam.
